Commissioner’s Authority (Texas)

Ins s 31.021 - Chief Executive

The commissioner is the department's chief executive and administrative officer. The commissioner shall administer and enforce this code, other insurance laws of this state, and other laws granting jurisdiction or applicable to the department or the commissioner. The commissioner has the powers and duties vested in the department by this code and other insurance laws of this state.

Ins s 843.151 - Rules

The commissioner may adopt reasonable rules as necessary and proper to:
  1. implement this chapter and Chapter 20A, including rules to:

    1. prescribe authorized investments for a health maintenance organization for all investments not otherwise addressed in this chapter;
    2. ensure that enrollees have adequate access to health care services; and
    3. establish minimum physician-to-patient ratios, mileage requirements for primary and specialty care, maximum travel time, and maximum waiting time for obtaining an appointment; and

  2. meet the requirements of federal law and regulations.
